Information on the internet

The Port Hedland Visitor Centre does not guarantee the quality of the information on the internet. It is your responsibility as a user of this WiFi Hotspot, to determine the validity, quality and relevance of the information obtained.

 

Logging in and out of the WiFi Hotspot

In order to use the WiFi Hotspot, you need a wireless enabled device with an ability to use a browser that has its own power source. You must agree to accept these terms and conditions of use.

You will be automatically logged out of the WiFi Hotspot if your access is terminated by reason of reaching the access time limit, a breach of these terms and conditions or/and the wireless connection of the WiFi Hotspot you are accessing is lost, disconnected or becomes out of range.

 

Reliability of the WiFi Hotspot

The Port Hedland Visitor Centre will use its best efforts to ensure stable and secure access to the WiFi Hotspot, but does not guarantee that the access will always be free of errors, virus, interception or interference.

Upon becoming aware of any malfunction of the WiFi Hotspot, the Port Hedland Visitor Centre will attend to rectification of the fault, but is not obliged to do so within any specified time frame.



Inappropriate behaviour

You are not allowed to access the Port Hedland Visitor Centre network for any purpose other than to use this WiFi Hotspot in accordance with these Terms & Conditions.

You must not interfere with the proper operation of this WiFi Hotspot or any part of the Port Hedland Visitor Centre’s network or systems.

You must not use this WiFi Hotspot, or attempt to use this WiFi Hotspot or allow anyone else to use this WiFi Hotspot to do anything which:

1. Results in you or the Port Hedland Visitor Centre breaking the law, or being involved in breaking any domestic or foreign law, order or regulation or a mandatory code of conduct. For example, don't illegally copy, use or distribute other peoples' copyright material;

2. Results in, or could result in, damage to property or injury to any person; or that harasses, menaces or stalks people;

3. Puts children at risk by enabling a child to access material inappropriate for a child, or by you establishing (or trying to establish), inappropriate contact with a child;

4. Unlawfully incites discrimination, hate or violence towards one person or group, for example because of their race, religion, gender, sexual preference or nationality;

5. Involves you engaging in any illegal business practices, misleading or deceptive business or marketing practice, including providing or promoting illegal pyramid selling schemes or unlawful gambling or gaming activity; or

6. Interferes with the rights of other people, that is you send, display or are otherwise involved in material which is obscene or defamatory or which is offensive or abusive; which infringes the Port Hedland Visitor Centre or any other person's rights (including intellectual property rights such as copyright, and moral rights), or which constitutes a misuse of the Port Hedland Visitor Centre or any other person's confidential or personal information. Remember, you are using this service in a public domain, namely the Internet.

You must not use this WiFi Hotspot, or attempt to use this WiFi Hotspot, or allow this WiFi Hotspot to be used by anyone else:

1. to send, or in any way be involved in sending, spam. Spam means unsolicited emails, usually in bulk. You must comply with the Spam Act 2003. Failure to do so may result in disconnection and/or blocking. We reserve the right to forbid you to use this WiFi Hotspot for commercial emailing or file sharing purposes.

2. in connection with any virus, Trojan horse, worm, cancelbot, time bomb or activity including a Denial of service attack that is designed to provide, or allow unauthorised control of, or result in an adverse effect upon a computer, a network or data (whether the computer, network or data is the internet providers or anyone else's);

3. to access or use, or attempt to access or use, the internet providers or anyone else's systems, networks or data (including through open relay, port probing and the use of packet sniffers), without consent, regardless of whether or not such access or use has any adverse effect upon the system, network or data;

4. to create, send or alter in any way and by any means (including spoofing and use of third party mail servers), the contents of an electronic message for the purpose of hiding, obscuring or deleting the source of the message or making the message appear to come from someone other than you;

5. to participate in peer-to-peer file sharing;

6. to manipulate or bypass the time and/or data usage limits of the WiFi Hotspot; or

7. to manipulate or bypass the WiFi Hotspot web filtering system.



Restricting your use

Your use of this WiFi Hotspot will be limited in time and/or data, including a “timeout” period, preventing reconnection after the time and/or data period has elapsed. If in our opinion your use of this WiFi Hotspot adversely affects the quality of the WiFi Hotspot received by other customers, the Port Hedland Visitor Centre may shape, slow, disconnect or block your access.

The Port Hedland Visitor Centre may revoke or limit your access to the WiFi Hotspot at any time, for any reason or no reason with or without notice.

The Port Hedland Visitor Centre reserves an absolute and sole discretion to limit or block any website and/or content using a web filtering system.



Security

The Port Hedland Visitor Centre cannot guarantee the security of the WiFi Hotspot at all times. Your access and use of this WiFi Hotspot is at your own risk. The onus is on you as user, to ensure that usernames, passwords and security-based information are kept private and the firewalls are installed to prevent unauthorised access.

The Port Hedland Visitor Centre is not liable for any kind of loss or damages you may sustain as a result of your use of the WiFi Hotspot.



Privacy

The Port Hedland Visitor Centre may collect data identifying different sessions of browsing, different devices and the websites viewed while using the WiFi Hotspot.

The Port Hedland Visitor Centre will collect and store the IP and MAC address of the enabled device that has accessed the WiFi Hotspot, once the terms and conditions have been agreed to.

The Port Hedland Visitor Centre is not responsible for the use that any third party may make of personal information obtained through use of the WiFi Hotspot and you should make your own enquiries to satisfy yourself of the applicable policies for use of private information by the websites accessed by you.



Release and indemnity

By using the Port Hedland Visitor Centre WiFi Hotspot, you release and discharge the Port Hedland Visitor Centre from any liability which might arise from the use of the WiFi Hotspot including liability in relation to defamatory or offensive material or any breach of the copyright which may occur as a result of use.

You agree to indemnify and must defend and hold harmless the Port Hedland Visitor Centre, its employees and agents, from and against all loss, damage, liability, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from your breach of these terms and conditions.

DIRECTIONS FROM THE AIRPORT

Left out of the airport onto Great Northern Hwy

Turn right at T-junction onto Wilson St and continue approximately 9kms to McGregor St
Turn right onto McGregor St and immediately left onto Anderson St
Continue along Anderson St until the Wedge St turn off
Turn right onto Wedge St

Park in the car park on the right side of Wedge Street next to the Port Hedland Visitor Centre and ANZ bank

Caravan parking at Marapikurrinya Park (at the end of Wedge St).
